Terms & Conditions

1/ This agreement commences once you have indicated your acceptance by signing the membership form.

2/You will be entitled to all the rights and privileges exercisable for the type of membership you have chosen. Different types of membership can be found on our website.

3/ You cannot transfer this agreement/membership to anyone else.

4/ As a monthly direct debit member of annual member you may bring a guest to the club to train with the consent of Silverback Gym staff prior to your guest arrival. Your  guest will be required to complete and sign the appropriate forms,, failure to do this will result in refusal of entry for your guest. Your guest is entitled to 1 free visit as a guest, after this they will be required to purchase a day membership or sign up for one of our membership options.

5/Upon joining the club and during your time as a member we ask you to declare:

a/I accept that I must take the time to familiarise myself with the instructions displayed in the club and on the fitness equipment regarding the safe use of the Club’s fitness equipment. If I decide that I require any assistance in the use of the fitness equipment I will ensure that I seek assistance from a member of staff.

b/I have considered my own personal fitness requirements and will exercise within my own abilities taking into account any disabilities/limits or restrictions I may have

c/I accept that it is my own responsibility to stop training if I feel ill or require assistance

d/I will decide if I have a medical condition that requires advice from my own Doctor/medical advisor before embarking on an exercise programme at the club

6/You confirm you are solely responsible for yourself and your safety whilst using the clubs facilities. If at any time you are unsure please ask a member of staff for guidance.

7/ You agree that you will only enter the club to train if you are well enough to do so. You agree to clean all the equipment you use immediately after you have finished using it.

8/ You confirm you have read and understand the club rules displayed in the gym. We expect you to leave the gym as you find it……..tidy.  Please put the weights back where you found them, failure to do this could result in a 2 week ban from the facility.


1/ Membership and entry to the facilities is by key fob. There is a charge of £5.00 for each key fob, including any replacements required. This is non-refundable

2/ The first months membership fees are collected from you by us by Direct Debit on or around the date specified when membership is taken out, they are not refundable under any circumstances with the exception of the Money Back Guarantee detailed below.

3/If you are looking to change your membership there maybe an admin fee charge of £10 at the point at which you change.

4/Your second Direct Debit for monthly membership fees will be collected 1 month after you joined on the date selected. Subsequent Direct Debits for monthly membership fees will be collected monthly thereafter. Each payment made is not refundable under any circumstances.

5/ If any Direct Debit is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £20. If, despite us having notified you of a missed payment, further payments are missed, we reserve the right to, at our sole discretion,  either suspend or terminate your membership and cancel your key fob, upon having given you written notice to do so. We may present an option to reduce the administration fee if the outstanding amount is paid within 7 days of becoming due.

6/You agree to advise us immediately of any change to the Membership details provided.

7/ You can request to freeze your membership for a maximum of 3 months. There will be a fee of £5 a month for this service. To enable us to action this service we will require proof that you are going to be absent from the facility for a minimum of 2 months. Membership cannot be frozen for a single month. After the maximum period of 3 months  your membership will automatically be un-frozen and will revert back to your monthly payments. Special circumstances can be agreed with the Silverback team.


1/ at some point we may need to increase the price of the membership. We will give you at least 1 months’ full notice of any coming price increase and will make it very clear when the price increase will take effect and how much your membership will cost after the increase. During this period you will have your usual right to terminate your membership in accordance with the membership terms, conditions and rules. If you do not terminate the membership by the date given to you in the notice then the price of the membership will be increased in accordance with our notice.


1/ You may terminate your membership at any point in writing to Silverback Gym and Fitness LTD.  Please allow 30 days notice for your membership to be cancelled. We will confirm in writing once your membership is cancelled. Please then contact your bank and cancel your direct debit. If you cancel your direct debit without 30 days notice you will be liable for a fee of 1 months membership.

2/ If you do decide to terminate your membership, your membership will remain in force until 30 days after your notice has been given

3/ Annual membership: If you decide to terminate your membership having paid for a year in advance you will be asked for 30days notice and your membership will be terminated 30 days from your notice given. Any refund will be calculated from the end of your 30 day notice period.


1/ As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing your membership application form. However, as per regulation 36 of Consumer Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to commence your membership immediately, or you ask us to start your membership early, you agree that if you subsequently cancel your membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used. For example, if your membership is £30 per month and you cancel your membership after 10 days of it commencing (having asked us to start it immediately) we shall refund you £20 and keep £10 which represents the membership you had used up until the point of cancellation.



1/ This daily membership commences once you have indicated your acceptance by signing the membership form, the medical questionnaire and the terms & conditions.

2/ Your membership will be activated on the date you specified

3/ You will be entitled to all the rights and privileges for the Type of membership chosen

4/ You cannot transfer this daily membership to anyone else nor transfer to another date.


1/You shall be entitled to cancel your daily membership the earlier of a/ 14 days after the date of purchase, but not after use; or b/the day before the date on which you selected your daily membership to activate. If you cancel during this period you will receive a full refund. After this period the daily membership fee is not refundable.


1/Members must be 16 years or over. Persons under the age of 16 will not be permitted in the gym area of the club

2/Fitness suite: Classes and/or clubs which use the fitness suite for their own clubs will be covered under their insurance for members under the age of 16.

3/Gorilla clubs/Silverback clubs held in the fitness suite: any clubs arranged by Silverback gym that are held in the fitness suite for persons under the age of 16 will be covered by Silverback Gym and Fitness LTD insurance. These persons under the age of 16 are not under any circumstance to be in the gym area unattended.

4/Personal training services provided in this facility will be provided by independent contractors. All clients trained at Silverback Gym must be a member.

5/All Monthly direct debit MEMBERS have access to a free induction to the facility and proper use of its equipment. It is the MEMBER responsibility to request this induction. All non-members using passes will be charged a fee for an induction.

6/It is each MEMBERS individual responsibility to wipe down the equipment and tidy away the weights they use.

7/MEMBERS are hereby required to use the safety features of the equipment. If a MEMBER is unsure of how to use a machine, he/she should obtain instructions from the staff or personal trainers.

8/Horseplay, vulgar language, abuse of equipment, abuse towards staff, working out while intoxicated, or any other inappropriate behaviour will not be tolerated and may result in the suspension or cancellation of the offending MEMBERS membership, and the balance of the contract being declared due and payable in full immediately.

9/You agree to comply with the Rules and Code of Conduct which are displayed clearly in the club and relate to use of the facilities and behaviour. We may make reasonable changes to the Rules at any time provided that we give you advance notice of the change. Advance notice will be posted on our website.

10/If we take no action, let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date

11/We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.

12/There may be occasions where we have to close all or part of the facilities for cleaning/maintenance. We will do our best to keep any inconvenience to our members to a minimum, but we reserve the right to carry out required maintenance for the safety of our members. You will not be entitled to any refund of part or, or all of your membership fees in such circumstances.

13/We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is out of our control.

14/We will not be liable or responsible for outstanding monies paid to a Personal Trainer. Personal Training is arranged directly with the PT and not with Silverback Gym and Fitness LTD.

15/As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill or care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau of Trading Standards Office. Nothing in these terms will affect these rights.

16/This agreement is governed by Scottish Law

17/ We may terminate this agreement with immediate effect on notifying you if you are in breach of the club rules.

18/Membership referral scheme: for every friend introduced by a member, that member will receive a reduction to their monthly membership cost by £1. The friend must sign up for a minimum contract of 1 year. The reduction in membership will commence 3 months after the friend has signed the yearly contract. For as long as the friends introduced remain as members you will continue to enjoy a reduced membership rate.  When the friend leaves the reduction is removed from your membership, when this happens you will be advised by email. Limits can be applied at any time. Silverback Gym and Fitness reserve the right to remove or terminate this referral scheme at any time. Any changes will be  noted on the website.

b/process your membership payment

c/inform you about special event days and promotions.

2/We will not give your personal data to any third party.
